The Service Contract ("Contract") This Service Contract ("Contract") establishes the agreement between MotionHost (referred to as "We," "Us," or "Our") and the user of MotionHost services (referred to as "You," "Your," "Reseller," "Client," or "Customer"). The terms and conditions this Contract outlines govern the utilization of MotionHost's services. By engaging with any aspect of MotionHost's services, You explicitly agree to abide by the terms and conditions specified herein.

This Contract encompasses comprehensive details regarding service delivery protocols, refund policies, Service Level Agreement (SLA) conditions, provisions related to free domain offers, guidelines for affiliates, terms about web hosting, acceptable use policies, and additional relevant provisions.

Service Guidelines

When you complete your payment successfully, you'll receive an automated receipt. It's important to keep this receipt safe for future reference. The receipt includes your unique customer username, which should be used for all communications and inquiries with MotionHost.

At MotionHost, we prioritize prompt service delivery following the completion of your signup process. Should there be any unexpected delays, we'll promptly inform you through email or telephone. Payment processing occurs upon successful service delivery.

We take pride in our customer support, available round-the-clock, every day of the year. Our dedicated team strives to respond to your inquiries within one hour of receiving them.

It's important to note any export or import restrictions that may apply to products and services offered on our platform, depending on your country of residence.

We ensure transparency in our pricing policies. Whether you use VISA or Mastercard, we do not impose additional charges. The final price remains consistent, regardless of your chosen payment method.

General Terms and Policies

The Service is provided to authorized individuals or organizations ("Subscriber" or "You"). Your use of the service is subject to the following restrictions. By using the Service, you agree to abide by all Terms and Policies. If you do not agree, you must cancel your account immediately and discontinue use of the Service.

Web Hosting

These Terms of Service and Acceptable Use Policies ("Terms and Policies") are integral to your relationship with MotionHost. By using your MotionHost account, You agree to all Terms and Policies outlined in this document.

Domain Name

Please carefully review the domain name and extensions before confirming your payment after purchasing. Once payment is made, you cannot change the domain name or modify its extensions. Additionally, there is no refund policy available for any domain name purchases. By using your MotionHost account, you agree to abide by all Terms and Policies outlined in this document.

Security and Third-Party Purchases

You agree not to access private areas of the Service. Promptly notify MotionHost of any unauthorized use of your account or security breaches. Additionally, if you purchase any of our products from a third party and experience security breaches through them, we are not liable. Therefore, ensure that you maintain ownership and control over your account.

Ownership Verification

Furthermore, we require valid proof or documents to grant access to any hosting or domain services. If you claim ownership of a hosting or domain, please use the control panel to contact us for any updates or issues. Contact [email protected]

Terms

The service is provided for as long as you wish to use it. MotionHost reserves the right to terminate or suspend the service at any time if it is used in violation of the terms of use or any BTCL violation.

Backups

MotionHost performs daily backups, but these are not guaranteed. They are intended for internal use in case of server failures. Clients should also keep their own backups of data on personal computers or storage servers. Clients are solely responsible for their data. After 1 month of suspension or termination of the account, a $30 fee will be required for backup restoration.

Service Level Agreement (SLA)

If Your service uptime falls below 99.9% in any given month, You will receive a credit for one free month. To claim this credit, it must be requested within 7 days of our monitoring showing uptime below this threshold. Planned maintenance work is exempt from this guarantee. VPS, Dedicated servers and other third-party products do not have any SLA.

Uptime levels are determined using our status page and monitoring systems exclusively.

Refund Policy

If you are dissatisfied with any aspect of our Service, please contact our support department, and we will attempt to resolve the issue. If the problem cannot be resolved, you may request a refund within 30 days. Refunds are unavailable for domain names, SSL Certificates, Domain Transfer fees, or any other products/services provided by third parties through MotionHost.

Refunds are not provided for VPS or Dedicated servers except as explicitly outlined in our Acceptable Use Policy or Terms and Conditions.

No refunds will be issued if we terminate your hosting or other services due to violating our Acceptable Use Policy or Terms and Conditions. Your statutory rights remain unaffected.

Credit on your account cannot be refunded and must be used for future purchases or renewals.

Setup fees are non-refundable.

Accounts purchased under a promotion, with or without a promo code, are excluded from the 30-day money-back guarantee.

Excess funds sent to MotionHost can only be reimbursed as an account credit and cannot be refunded. Read more Refund Policy

Affiliates

Affiliates must use the affiliate link provided without alteration, hiding, or modification. Affiliates are prohibited from spamming or advertising in violation of hosting site rules. Violations will result in the affiliate link being reported.

Suspension and Termination Conditions

Adherence to these Terms and Policies is mandatory. Violations may result in suspension or termination of your account. Grounds for action include, but are not limited to:

1. Violation of applicable laws, regulations, or treaties.
2. Hosting adult content. (18+)
3. Utilizing the account as a backup service.
4. Abuse or infringement of others' privacy or property rights, including spamming.
5. Provision of false contact information.
6. Uploading or storing pirated software.
7. Distribution of copyrighted material.
8. Using hosting services for file or image storage.
9. Mail bombing.
10. Hosting phishing content.
11. Excessive use of resources affecting bandwidth.
12. Forgery of identity or location.
13. Engagement in harassment or denial-of-service attacks.
14. Provision of false data.
15. Unauthorized access attempts.
16. Forgery or misrepresentation.
17. Running unauthorized server programs.
18. Adding addresses to mailing lists without consent.
19. Betting platform related websites are not allowed.
20. Unauthorized relays through third-party systems.
21. Interference with service to others.
22. Cancellation, superseding, or interference with email.

Intellectual Property

MotionHost does not review or examine messages, files, or materials on the Service. Complaints regarding alleged copyright infringement should be sent to [email protected]. We will address these promptly but are not responsible for the accuracy of third-party materials. You are responsible for your postings and agree to indemnify MotionHost against claims arising from them.

Liability

Use of the Service is at your own risk. Except for information, products, or services provided by MotionHost, neither MotionHost nor its affiliates control, provide or are responsible for information, products, or services accessed through the Service. MotionHost is not responsible for any loss or damage from using third-party materials. You agree to indemnify.

For voice communications using the Service, MotionHost is not a telecommunications carrier or provider. The suitability of the Service for such use is not guaranteed. All connection, transmission quality, and communication accuracy risks are solely on You. MotionHost is not liable for failure or quality issues in such use.

You are liable for damages or loss of Service from spamming or violations, including system shutdowns, retaliatory attacks, and loss of peering arrangements. MotionHost may pursue claims in Court. MotionHost has no financial liability to You.

VPS CPU Usage or VPN/Proxy Usage Policy for VPS

Clients agree not to run processes on their VPS that create a CPU load above 0.9 for extended periods or cause a high CPU load on the host node. Disruptive usage may result in reboot, shutdown, or suspension of the VPS.

VPNs and proxy servers on our VPS services are prohibited unless expressly permitted. This ensures network security and integrity and prevents misuse. Prohibited activities include bypassing security measures, illegal activities, network abuse, and email abuse. Violations may result in suspension or termination of VPS services and potential legal action. Users must adhere to this policy to ensure compliance with our terms and conditions.

Content

You understand that the Service may include controversial, sexually explicit, or offensive material. MotionHost is not responsible for such materials. Use screening software or methods to limit access to objectionable content.

Disputes

Disputes arising from your use of the Service or subscription will be submitted to binding arbitration under Bangladeshi and International law.

Governing Law

This Agreement is governed by Bangladeshi laws and International laws.

Cancellation Procedure

Cancellation requests must be submitted through the client area. Click the package and find the 'Request Cancellation' in the package left section. Complete and submit the form. No other cancellation forms are accepted.

Immediate cancellation results in service termination within 24 hours.

To avoid charges, cancellations must be submitted before the invoice for that billing cycle is due. Cancellation requests are accepted only if the account has no overdue invoices.

Dedicated server cancellations must be submitted 7 days before the renewal date to avoid charges for the next billing period.

Discount Vouchers / Coupons

Only one voucher can be used per transaction. The remaining amount is forfeited if the order value is lower than the voucher value. Vouchers are restricted to one per customer and can be redeemed against Shared, Reseller, VPS or Dedicated services.

Payment

You are not eligible for refunds or complaints regarding payments made through any third-party. We only recognize invoices listed in our control panel. If you complete a payment without using the listed accounts in the Pay section, we are not liable for the payment made or any services obtained.

Warranty

MOTIONHOST MAKES NO EXPRESS OR IMPLIED WARRANTIES REGARDING THE SERVICE, INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. NO ORAL ADVICE OR INFORMATION GIVEN BY MOTIONHOST OR ITS EMPLOYEES SHALL ALTER THIS SECTION. THE SERVICE AND ANY SOFTWARE PROVIDED ARE "AS IS, AS AVAILABLE"; MOTIONHOST DOES NOT WARRANT THEY WILL BE ERROR-FREE OR UNINTERRUPTED. MOTIONHOST DOES NOT GUARANTEE THE SECURITY OR BACKUP OF YOUR DATA.

Amendments

MotionHost may amend these Terms and Policies at any time, with amendments posted on the terms of use section of the Service.
